These Terms and Conditions of Use comprehensively and bindingly regulate the methods of access, use, and enjoyment of the digital service called "Racketpedia" (hereinafter, the "Service"), managed and provided by nexTennis s.r.l., with registered office at Corso Mazzini 16, 27100, Pavia, VAT number 02716850181, as provider and manager of the platform.
The Service consists of a digital platform accessible via the internet that offers users a wide range of informative content, technical tools, reviews, comparisons, insights, as well as other services and features related to the world of sports, with particular reference to tennis and sports rackets.
The use of the Service implies full knowledge and acceptance of the rules set forth herein, which constitute a contract between the provider and the user.
Access to and use of the Service by the user imply full, unconditional, and unreserved acceptance of all these Terms and Conditions of Use. If the user does not intend to accept these conditions, they are advised not to use the Service.

The Service is provided entirely online, through access to web platforms and/or dedicated applications, without the need to download content in physical form or on physical media.
Racketpedia grants the user a personal, limited, non-exclusive, non-transferable, and revocable license, valid for the entire duration of access to the Service, solely to use the Service for personal, non-commercial, and non-profit purposes.
Any other use, in particular reproduction, distribution, public communication, modification, sale, or commercial exploitation of the content or software provided by the Service, is expressly prohibited and may result in legal actions to protect the rights of Racketpedia and its licensors.
All contents and materials published on the Racketpedia platform, including but not limited to texts, images, trademarks, logos, graphics, software, databases, are the exclusive property of Racketpedia or its licensors and are protected by national and international copyright, trademark, patent, and trade secret laws.
The user agrees to respect such rights and not to use or reproduce the contents without express written authorization from Racketpedia or the rights holders.
The user undertakes to use the Service in compliance with applicable laws, public order, good morals, and this contractual agreement.
In particular, the user agrees not to use the Service for unlawful, fraudulent purposes, harmful to the rights of third parties, or in a way that compromises the security, integrity, technical stability, or functionality of the platform.
Sending, uploading, or sharing offensive, defamatory, obscene, racist, violent, or otherwise unlawful content is prohibited.
The Service is provided "as is" and "as available," without any express or implied warranty, including but not limited to any warranty of fitness for a particular purpose, accuracy, completeness, or timeliness of the content.
Racketpedia does not guarantee the continuity, security, availability, or absence of errors or malfunctions of the Service, nor assumes liability for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use the Service.
The user uses the Service at their own risk and responsibility.
Pursuant to Article 59, paragraph 1, letter o) of the Consumer Code (Legislative Decree 6 September 2005, no. 206 and subsequent amendments), it is specified that the right of withdrawal provided for consumers is expressly excluded in cases of supply of digital content not provided on a physical medium, where the execution of the contract has begun with the express and prior consent of the consumer, and with the awareness that they would lose such right.
By accessing the Racketpedia Service, creating an account, or using it for the first time, the user expressly declares to provide their prior and unequivocal consent to the immediate start of the digital service.
With such consent, the user expressly waives the right of withdrawal as regulated by the aforementioned legislation.
Users are therefore reminded to carefully evaluate the decision to activate or use the Service, bearing in mind that once usage has started, it will not be possible to exercise the right of withdrawal or obtain a refund, except in cases of violations attributable to Racketpedia.
These Terms and Conditions are governed and interpreted in accordance with Italian law.
Any dispute arising from the interpretation, validity, execution, or termination of this agreement shall be subject to the exclusive jurisdiction of the consumer's court, where applicable, or alternatively the court of Bologna, unless otherwise mandatorily provided by law.
Racketpedia reserves the right to update, modify, integrate, or replace these Terms and Conditions at any time and without notice, in order to comply with regulatory changes, technological evolutions, or service improvements.
Changes will be communicated to users by publication on the website or through direct communications and will be effective from the date of publication, unless otherwise indicated.
Continued use of the Service after the publication of changes implies tacit acceptance thereof.
